Unlike unauthorized entry, which is criminalized under INA § 275 / 8 U.S.C. § 1325, a visa overstay does not appear anywhere in the criminal code. There is no statute in Title 8 or Title 18 of the U.S. Code that makes overstaying a visa a criminal offense. No criminal charges.

If he entered without inspection, he wasn't going to get a green card, even if he married a US citizen. You can get a waiver for visa overstays, but not for entry without inspection.
