1/38 Yesterday, I highlighted how Kash Patel's poor handling of the case could put it in jeopardy. But today the FBI's lead-podcaster, doubled-down on *STUPID*, in a public interview that is a defense attorneys dream! Let's breakdown the incompetence:

2/38 An important piece of context to keep in mind, is they desperately want to make this a Federal charge crime, so they can keep it untelevized, control the narrative, and seek death penalty with a jury base that isn't 90% mormon.

4/38 Immediately defense is going to frame this as personal matter. They'll seek a Motion to Suppress, attempting to exclude evidence that is from the FBI instead of local law enforcement, arguing it's tainted by personal relationships.

15/38 Congrats Kash, you just tainted that evidence. Now defense can argue you poisoned the jury pool, by giving an affirmed, inaccurate statement, about scientific evidence, without hearing expert testimony.

17/38 The US 6th Amendment guarantees a fair trial before an impartial jury. DNA evidence is always carefully disclosed as its seen as "magical evidence" that's tough to erase from the minds of a layperson.
18/38 Saying this on national TV means the defense has grounds to pursue: -Motion to Dismiss for Irreparable Prejudice -Motion for Bench Trial (waive jury and only have a judge) -Alternative Motion to Strike Death Penalty (arguing non jury is now impartial enough for it)

20/38 Patel then goes on a ramble of how the "FBI secured the scene" and did "great investigation work" which I won't breakdown in depth but there are about 30~ contradictions to timelines and previous statements, all which will come up.

25/38 Kash then says "the family said he subscribed to left wing ideology" - even though he tried to disclaim it, this is speaking to motive. It's a Violation of Presumption of Innocence, it's also a matter of hearsay that would be inadmissible.

26/38 It will also give the defense easy grounds to fight back against any Federal charges if filed arguing that the DoJ is pushing politics into a criminal trial. Unless the suspect has specifically noted their ideology as the cause, then this always hurts prosecution.

What is typical time for charging docs to be entered. I thought I read somewhere there are state charges but have seen nothing about an arraignment (did I miss it). Seems like this part is moving slow

Look I enjoy a good conspiracy theory as a story that you can go out and look for evidence for/against. In this case, there is so far no evidence to suggest any type of conspiracy or coordination in any legitimate way. So while in these times we should be open to remarkable

I asked why didn't he recuse himself since he was a personal friend of Kirk. And, while he should say nothing, the most he should say is that it is an ongoing investigation and all avenues are being pursued so that the perpetrator can be brought to justice.
I covered crime and justice for almost 30 years and never saw federal law enforcement commit all the amateur hour and self-inflicted mistakes this boob did in a few days. A defense lawyer's dream.
Poster boy for why you want competent people leading the FBI. Congress should enact legislation requiring only actual FBI agents with a minimum number of years be appointed in ALL senior positions.

If the government, were responsible for this killing, maybe they are purposely botching the investigation of the patsy so that his defense will focus on their missteps rather than digging into who actually did the killing.

Great thread. The Senate didnโ€™t want to listen to reasonable people when they said he was patently unqualified. You want your appointments to be at least 90-10 vote or better. When youโ€™re 51-49, youโ€™re not picking the right person for the job (for any Agency position)

This is dumb. They seemed to have no problem with putting Derek Chauvin on trial. They have a photo of a juror in a shirt that read "get your knee off our knecks!" They held the trial in the same city Floyd was killed in. Yet he's still in jail. Shoulda hired your fantasy lawyer.
I have always had the opinion that the most dangerous people new on the job were the ones overly self-confident and would not ask questions.
