Again, the Secretary of State has no authority to “revoke” green cards.
UPDATE — Secretary of State Marco Rubio has now commented on the Trump admin’s detaining & attempted green card revocation of a Columbia Gaza encampment student negotiator:
“We will be revoking the visas and/or green cards of Hamas supporters in America so they can be deported.”
While the State Department CAN revoke *visas* with very little legal process involved, stripping someone of a green card is done by DHS (not the State Department) and requires filing formal charges alleging a violation of immigration law and a removal hearing in front of an immigration judge.

DHS today directed reporters to WH for comment, if that’s clarifying at all
Of course; as I said earlier, it is an extremely worrying sign of the White House directing arrests of specific people on ideological grounds. But that doesn’t mean that they are actually going to “strip his green card” outside of a normal process.
Now, a visa, that they could have done easily.
Rubio is now a puppet of the administration. What a weak man
are they setting themselves up to use the FTO designation to justify it? that’s how I’ve been interpreting the repeated attempts to portray people as “Hamas supporters.” obviously they need to prove actual material support but at least that’s how I’m reading the rhetoric
If Rubio thinks he can take away Green Cards for no reason, we should all be concerned that the Trumpists may soon be taking away our citizenship and our passports.
They don't care if they have the authority or not. Begs the question: who will *stop* them?
This is chilling. The next step is arresting American citizens for demonstrating. We are in a bad place and headed down a very very bad road.
Trump has already tweeted that he plans to do exactly that.
The Trump administration only recognizes laws that benefit their actions and ignore the rest. We'll need to sue them to get any justice.
The Supreme Court said you can put an American Flag on the floor and totally desecrate it. Does Marco Rubio really believe the government can deport someone because you don’t agree with them?
Come on midterms….
Since when has this administration followed the law?
Exactly.
Can they do _____? Is a useless question
They’re going to do what they want
They MIGHT go so far as another EO to be challenged in court after court until it reaches SCOTUS to interpret what the law is now
We cannot count on what WE think the law is anymore
That’s what time it is
I think we’re well past what is or isn’t a legal process. They can easily disappear someone to one of the new jungle camps outside of the US. Without contact with family or legal help they will be voiceless.
There is no law and order under this regime. Final question is will SCOTUS say it is ok for regime to not obey court orders
I guess their position continues to be “who will stop us?” and so far we’re not having too much luck on that front. How many injunctions have they ignored at this point
First they came for the socialists, and I did not speak out, Because I was not a socialist.
Then they came for the Jews, and I did not speak out, Because I was not a Jew.
Then they came for me—and there was no one left to speak for me.
Eventually no one can pass the purity test if a fascist regime.
And who, pray tell, little Marco, will decide if someone "supports Hamas" as opposed to supporting the right of Palestinians to their own country?
What about people who support terrorist Trump, who tried to overturn democracy in your own country?
Crawl back into your snail shell, Marco.
I’m wondering whether a question as to whether the Israeli government requested the detention of Mahmoud Khalil is best directed to the State Department, the Department of Homeland Security, or the White House.
That’s the official process, yes, but there’s no guarantee of anything these days. It’s as bad as the doomsayers were saying.
As someone who supports human rights and the anti-genocide movement, I’m definitely staying out of the US.
In other words, they have totally ignored the law here and Rubio's stance means they intend to keep ignoring it. What has happened to America and why aren't people up in arms about these abuses?
It was never about undocumented immigration. It was always about white supremacy.
Or else what? What will happen to them when they don't follow the legal process?
They’ll be ignored by most national news media
Sure, LEGALLY that’s all they can do.
But they’ve already demonstrated that they don’t care about laws.
If only there was a choice to vote for a candidate you knew was not going to do this plainly illegal shit.
And every Republican did also. He would have been confirmed no matter what. I agree, Democrats should no longer give Republicans one vote. But they are not listening. 10 Democrats voted to censure another Democrat. We have to find candidates to primary these weak Democrats.
They understand that if they did it legally, they would lose, so they're not going to do it legally
Even if the government can do something, doing it *because* of the content of speech is obviously a first amendment problem.
If you don’t already know, it is time to find out if your city has an ICE facility or DHS offices and start protesting against the this egregious and illegal overreach.
Again, who will make them accountable? Who would enforce? Yep, exactly, nobody. They can do pretty much what they want.
Rubio doesn’t care about the Rule of Law. trump has never cared about the rule of law. It is the Constitution and Rule of Law that makes America special. They are un-American.
Kinda why they recently went after Immigration Judges and referees to resign.
“Requires” implies there is someone willing to enforce the rules as written. I’m not sure we’re operating in that realm right now.
USA is under fascist dictatorship.
There is nothing about the law that will be followed.
Separately, is there *any* authority to detain him? Even if they are seeking a revocation of his LPR status, he isn't currently removable, and so I don't see any legal authority to detain him absent a warrant and charging him with a crime.
It concerns me that the Secretary of State doesn’t know this.
Nope, not any more. Now it's whenever Trump or Musk feels like it
We were warned that participating in the International Women’s Day political demonstrations as non citizens would subject foreign citizens to detention or deportation. It does seem potentially risky.
