Trump did not have to allow the chips to be exported AT ALL. The agreement was not a “tax” it was an agreement between the federal government and Nvidia to allow them to export the chips.
But Nvidia did agree as a condition of being given export permission for computer chips, which are closely controlled under EAR and ITAR.

This is effectively just a negotiated ITAR exemption fee. You'd have to argue that entire system is unconstitutional (and could maybe have a case,) but it would mean you couldn't put any restrictions on exporting sensitive tech

They're producing the chips in Taiwan. So, if they want to import any chips back into America they'll have to pay tariffs or sign a trade deal with whatever agreement is satisfactory to both parties.

Giving a cut of revenues to the government is bizarre. A cut of profits maybe (that's tax). But 15% of revenues is financially grossly irresponsible, and I'd expect the CEO and CFO to be crucified at the next AGM. (For MAGAs, that's a metaphor, not an actual execution).

It’s not unconstitutional if the companies agree to the arrangement as part of the terms to obtain an export license for critical goods that otherwise would not receive said export license. But yes - it does feel like a shakedown - but a legal one unless they sue.
