was assured in “SCOTUS upholds trump’s use of alien enemies act” that it was some huge MAGA win guess not 😂 sure any POTUS can use the law but they have to secure the receipts (which doubt trump even knows how to do that)

Confused. What is Sotomayor dissenting from? The majority ruled in favor of due process.
Not good enough...but the best we're going to get. Supreme Court could've checked the power of the Executive right there....and didn't.
Lawyer here. But by using the shadow docket to dictate habeas filings in Texas (& so endorse implicitly the regime’s bad faith conduct so far), the majority consign all the deportees now in El Salvador’s to CECOT hell-on-earth indefinitely.
Why doesn’t the court address all the actual issues of the case? Why did they feel they needed to rule in 5 seconds rather than have an actual hearing?
So this is another Korematsu situation: the government is acting illegally in our opinion BUT we feel completely powerless to stop them so….illegal acts get to happen.
So what about the ppl they already did this to? Can the Goverment be ordered to bring tham all back and start over?

Folks, beware the headlines. SCOTUS hasn’t ruled the Alien Enemies Act constitutional for peacetime. They just allowed deportations to proceed for now while the courts figure it out. Big difference.

Can someone in this thread explain how you give 10 million+ Illegals an hearing( due process)….if the average hearing is 30 minutes, that comes out to almost 570 years
So if an immigration judge rules that an illegal should be deported and gives final orders as such, does that count as due process? Or do they get another round of appeals outside the immigration court system?
And the majority also agreed that the Democrats can’t do what they are doing - forum shopping for activist liberal DC judges to get the unconstitutional outcome they want.
Since your ilk opposes you should be saddled with the responsibility of housing and administering all “humane” necessities until further adjudicating is complete.
Why didn’t all 9 agree that allowing millions to enter our country, in flagrant violation of the law, without notice and due process for the American people, i.e. checking who they are and why they’re here, was illegal? Because it wasn’t politically convenient. We are a country

So in removing the alleged TdA members to El Salvador without giving them ANY notice or opportunity for judicial review, the Trump regime knowingly and deliberately violated the Constitution. They knew at the time it was illegal, and they did it anyway.
What’s funny is like Dems hand picking judges and courts, Republicans will do the same and call it “due process” and be within the ruling for deportation. This stops nothing
