1/15 The FBI may have missed their window due to the incompetence of the Chief-Podcaster. The shooter now likely has a good lawyer that has told him to not say a word because of how badly this case has been managed:

2/15 When capital punishment is on the table, and people are cooperating, but you're in a state where pursuing the death penalty is politically unpopular, the state prosecutor would likely be swayed by an early plea deal offer to not pursue capital punishment.
3/15 But, that hasn't happened yet, and MAGA is desperately trying to make it a federal case (via hate crime or RICO claims) in order to ensure that no plea deal can be reached at the state level.

1/26 This is a good question, and its the *ROOT* of why the FBI has been pushing disinformation (even to the media and the Governor) They are *desperate* for this to be a Federal case for specific political and legal reasons and it explains all their "claims": x.com/16892412490253…
4/15 But a good defense attorney, is going to see a few things: 1) The crime scene was deeply compromised People were stealing hats and walking in and out of the crime scene for more than 30 minutes after the shooting.
Two individuals running on grass near a fenced area with a banner displaying "AMERICAN COMEBACK TOUR" in red and blue text. One person wears a gray shirt and carries a blue water bottle, while another in a black shirt and khaki pants holds a red object. People and equipment are visible in the background.
5/15 2) It took police about 40 minutes to formally lock down the campus, supporting point #1, and the temporarily arrested another man who had shouted "he had done it" (The man is mentally unwell and known as a local trouble maker but it still muddies reasonable doubt for a

9/15 To make their case that the FBI was trying to push this politically, they may even take a really rare step in seeking to subpoena communications between the FBI and the Press to show intent.
10/15 And, if Kash does try and push for the federal case, even in front of a friendly judge, they then have to climb the high bar of either proving hate crime or RICO, which basically need written proof or recorded audio.
11/15 Kash was slow, only got this kid because his family turned him in, and put out mixed narratives for a political cause in the court of public opinions. That is the kind of stuff that tanks a trial.
12/15 They already would have had a hell of a hard time getting a young Mormon guy given the death penalty in the most heavily Mormon district in Utah, and now they may have a struggle to even get a conviction if he doesn't cooperate.

11/26 Depending on the county where he is tried (Utah County is where the shooting was), the County is 90%+ Mormon. This means the jury is *very* likely to be all Mormon.

13/15 You have to remember, in our legal system, it's the job of the defense attorney to either defend your innocence (or at least get the death penalty off the table) no matter what. Even if you did it. And so if you can win on a technicality - you bet your ass they'll try.
14/15 In a case like this, I would have expected that the shooter would be cooperating already and seeking a plea, or making the argument that their cooperation merits not pursuing the death penalty. The fact they aren't is telling.
15/15 And I assume it's because some experienced (likely Mormon) defense lawyer saw a high profile case, and saw Kash over here dropping the ball and went "yeah, that's a shoe in" It's another reason why we don't put inexperienced partisan hacks in charge of things.
Kash Patel stands at a wooden podium, wearing a dark suit, white shirt, and patterned tie, with a pin on his lapel. An American flag is visible in the background. Other individuals in formal attire are partially visible behind him.
PS - and lets be clear, I'm not saying he will get off with this crime, nor that he should. I'm just saying any defense worth their weight in salt sees Kash's screw ups have left a massive opening that they'd be foolish not to try for, and that's likely the only reason that he'd
Exhibit A for the defense will be shit like this. Claiming Trump officials said this, but Trump won’t take the stand of course, which just leaves doubt that prosecutors can’t easily patch.

It doesn't help matters that the entirety of Utah desperately wants this young man to NOT be the shooter. The absolute chaos, lack of procedure and evidence spoilage that has gone on is staggering. I have doubts that a proper autopsy was even conducted.
In Utah an autopsy is required before embalming in violent deaths, and so even though not released one was likely done. Autopsies can be really quick though when the cause of death is glaringly obvious.
95% chance they will call patel and trump as witnesses and subpoena their communications due to the co-ordinated holding back the announcement of his arrest
The crime scene should have been cordoned off immediately by local cops. The scene was clearly tampered with. When the story broke, the FBI should have responded promptly. The local police & Patel have some 'splainin to do. Btw, Patel has no idea what he's doing.
Are any of our US civil rights sacrosanct now? Constitution's Fifth Amendment protects people from being forced to give incriminating testimony.
Nothing here is disputing that? My point is an analytical one, that when young people are arrested in capital punishment cases, both them and their lawyers tend to push for cooperative plea bargains in exchange for removing death penalty. Not doing so signals confidence of an
A) Typically young people when arrested for serious crimes forget to do that. B) There is a difference between remaining silent and cooperating via your attorney C) When there is a potential capital punishment on the table your attorney may have you be cooperative by signalling
One thing bothering me is Nick Sortor's post claims they have cell phone pings. If so, why wasn't that in the PC affidavit to establish the alleged shooter was there at the crime? Was the video of the man on the phone someone else?

No this is just clearly bs. If you have hard evidence you don’t delay to “smoke someone out” you just go get them. Also cell phone pings can’t be the first piece of evidence because: A) There were a lot of them there B) You need a warrant for them So they would have got the
Did he actually admit to his parents that he committed the crime or did he just tell them he was simply the person in the surveillance picture? I’m hearing conflicting information on that score.
No idea, and we’ll never get the truth on that. A minister can’t be compelled to testify. And while a parent can, prosecutors almost never use it, as juries would find forcing a parent to testify against their child in a capital punishment case so heartbreaking that they will
I've been wondering for a while, regarding this case and others, whether Trump's prejudicial statements could cause a mistrial. I'm remembering Nixon and the Manson case.
Mistrial is a big thing to swing for, and even with something as big as Presidential statements it’s really hard to get. The defense has a few potential paths here, but if they try and take too many outs they may come off slimy to the jury. My guess is instead of target Trump’s

You're saying that allowing him time to get a good attorney was bad law enforcement ("missed their window") ("now likely has a good attorney")? Whatever he's done, he should have a good lawyer. Bemoaning the possibility he won't then face execution is vengeance, not justice.
No, they missed their window not in a time sense but in threading the needle to meet their own high bar of wanting capital punishment. It’s worth actually reading the thread before making retorts calling it bemoaning.
It’d be chaotic. I think it’s likely they get conviction but no death penalty on state crime. But if they try and upcharge to the bogus federal charges, and combine that with these screw ups, then… I dunno, that would be tough for them and since Utah won’t retry a case that
You, defense will easily be able to throw out any juror they don’t like with a massive list of questions covering jury poisoning. They’ve basically given defense carte blanche on jury construction
You’re an idiot. All defendants can ask for an attorney at any time during questioning, there is no widow of opportunity to miss. The police don’t get any free time to interrogate a suspect before an attorney must be brought in, an attorney can be requested at the time of arrest
This is definitely my take, too. State will plead life to see how this is handled by the feds. A trial would be messy. Conspiracy MAGA is already crafting video and other narratives about other shooters and body guards.
Kid isn't going to survive the trial. Questions will remain unanswered, and people will just be expected to accept thr governments narrative. Watch.
They keep saying that the shooter "isn't cooperating in the investigation." Tha fuk? That's an odd way of saying "the suspect is exercising his constitutional rights and doesn't have to tell the cops a good goddamn thing." Never talk to the police.
The lawyer will also argue that Tyler responded to discord messages within 1 minute of being tagged saying it wasn’t him, while the shooter should have been ditching a gun and running through the woods around that time.

Alleged Charlie Kirk assassin Tyler Robinson is not cooperating with authorities, according to the Governor. His romantic partner is trans and transitioning from male to female and is cooperating. Latest here: youtube.com/watch?v=cHYoIU
Being that Robinson's father is ex LEO is it possible he coached his son to not say a word? It seems to me, had his father not turned him in, we likely still wouldn't know who was responsible. His father likely knew this.
He confessed to his father-you think his father turned in his own son for the hell of it?!? They have way more than you and me BOTH know and the boyfriend is also cooperating. I wouldn't worry about a damn thing-they got it covered
The & compromised this case. Any competent lawyer will be able to raise reasonable doubt JUST with the crime scene. Add on the multiple posts/claims, the removal of evidence, removal of the body, and the interference into the investigation. It’s insane
Okay. First of all, most of the stuff that you are critical of is not FBI responsibility, but local and campus police. The first 30 minutes is always local level law enforcement, not Federal. So let's put responsibility where responsibility lies. 1/2
100% correct and ALSO i'll bet that his lawyers will 100% for a dismisal of all charges because of the MISSIVE SCREW UP by the FBI AND THE UTAH PD AND THE GOVERNORS RHETORIC
He’s going to get off scot-free due to mismanagement of the case. Feature not bug? Hard to tell with these guys.

I would love to know who the killer's lawyer is. MAGA wouldn't have needed to spend so much energy trying to create a political narrative for the case. The sick little minds of their supporters would have done the same “job.”
They also have facial recognition, which they already identified was him so there's no denying that-it's basically like DNA
You do realize that some people start from the position of "don't cooperate with law enforcement "... and people who commit assassinations or other high profile crimes are more likely to start at "don't cooperate " as well... especially given him saying he rather die than turn (1

Spot on. There are so many holes in the story, timeline, evidence chains. Any reasonable jury would have an eyebrow up.
There is no way this kid took that shot. Over 200 yds out and a single shot. Then he disassembles the rifle, jumps off the building and runs through the woods, reassembles the rifle and leaves it where it can be found. #Mossad
