Lots of reporting suggested that, this time around, Trump and his lawyers would avoid the sloppy legal work that plagued his first administration so they’d fare better in the courts. I see no evidence of that in this round of executive orders. This is poor, slipshod work obviously assisted by AI.

Typos and formatting errors get repeated across EOs, revealing extensive use of copy-paste. The rhetoric sounds like a ChatGPT imitation of the 5th Circuit’s laziest rulings. And the legal arguments are frequently fringe in the extreme, in a way that will likely piss off Roberts and Barrett.
Maybe the Trump administration’s legal output will improve when Bondi is confirmed as AG and she can staff with the DOJ with at least marginally competent MAGA lawyers. But the early signs here are not encouraging. Remember that CJ Roberts repeatedly DQed Trump policies based on bad lawyering.

I had to read it twice :-) people are traumatized. I looked at your page and you have some really good ideas. I like the idea of seeing of states can prosecute these assholes.

Why would they care? Who cares what the courts say or do? They have no enforcement mechanism. Trump owns the military. Trump owns Congress. Trump owns SCOTUS or ignores it. Trump can ignore anything he wants now because there’s no one and no mechanism to make him follow the law. This is FASCISM.
They don’t need to pass judicial muster. They own the courts.
Their stupidity, laziness, and hubris will screw them up every time.
But the sheer volume of it may overwhelm both opposition groups and the courts. Is that not the blueprint they are following?

The difference now is that the Supreme Court has a lengthy history of saying the law is whatever Trump and his lawyers want it to say.
He forged Electoral College votes, held a press conference displaying reams of blank papers purporting to be divestment documentation and has a long history of this sort of thing. Are we sure he's actually signing these things? That the pages say what's purported? Anything?

I think that people are working with different definitions of sloppiness. These orders were issued on Day 1. It will be hard for people to keep track. That was presumably the plan. In contrast, the prior administration made sure every t was crossed and every i was dotted. How'd that work out?

I appreciate the legal insight. But the "guardrail" here is that everyone takes the same legal position, eg that independent officials defer to legal judgement and do not obey in advance of it. The lesson of 1930s Germany is that these guardrails were simply bypassed or ignored. /1
Sincere good luck to those who will seek to use legal means to hold back the tide of "sloppy legal" EOs, or those who will later improve upon them or legislate. But in the meantime, the signal has been sent and some will take the EOs as they are. The only true legal safeguards are educated humans.

I don’t think it matters if the courts cave to him to. The law is what the courts and Congress say it is. As far as I can tell Trump has pretty well captured the federal judiciary from the appellate level up to the Supreme Court.
